TERMS AND CONDITIONS (CGV)

These general terms and conditions (GTC) apply to all purchases of products or services made from RED-DOLPHIN sàrl via its online store. The masculine form “customer” used hereinafter naturally refers to both customers and clients. Online offers of products and services are valid only as long as they are visible on the Site and within the limits of available stocks. Images appearing on the Site are for illustrative purposes only and do not form part of the contractual conditions. Information contained in catalogs and explanatory leaflets is given for information purposes only and does not constitute a contractual document.  
 

PRICE

Prices shown on the Site are in Swiss francs only. They are inclusive of all taxes (VAT) and include the advance recycling fee (ARF). However, they do not include shipping and handling costs, which will be invoiced separately. All orders are payable exclusively in Swiss francs. RED-DOLPHIN reserves the right to modify its prices at any time, but the prices invoiced to the customer for products delivered are those in force on the date of the order and which appear on the order confirmation.  
 
 

CONCLUSION OF CONTRACT

The products and prices published in the online store constitute an offer. However, this is always subject to the (resolutive) condition that delivery is possible or that the price indicated is free of error.
 
The contract is concluded as soon as the customer places an order with RED-DOLPHIN. Receipt of the order is confirmed to the customer by an automatically generated e-mail sent to the address provided by the customer. The automatically generated order confirmation e-mail does not constitute a guarantee of availability or delivery. It merely indicates to the customer that RED-DOLPHIN has received the order and that the contract has been concluded, subject to delivery being possible.
 
 

ORDER

An order becomes final only after its acceptance by RED-DOLPHIN. The sending of the order by the customer implies his adhesion to the present general conditions of sale in their entirety, to the exclusion of all other terms or conditions. RED-DOLPHIN reserves the right to refuse a customer’s order.
 
 

PAYMENT

The price invoiced is the price indicated on the order confirmation sent to the customer. Unless otherwise agreed, all products and services are payable by bank transfer (eBanking) or by credit card accepted by PayPal or Stripe.
All payment transactions are carried out in a secure area, using the highest security standard (https://). RED-DOLPHIN does not store your payment details (no credit card information is recorded by our system).
 

EXCHANGES, RETURNS, WARRANTY AND CLAIMS

The customer shall send claims for defective goods and/or services and returns directly to RED-DOLPHIN and shall settle with RED-DOLPHIN the details of the procedure. The existence of such disputes does not release the customer from his obligation to pay the invoice or the total value of the dispute.
 
In the case of returns of goods purchased on account, reimbursement will be made to the bank or postal account indicated by the customer and made out in the customer’s name, provided that the customer has paid the original invoice in full and has not made any further purchases within 60 days. 
It is the customer’s responsibility to check the merchandise immediately upon delivery and to make any reservations or claims regarding possible defects or non-conformities. As a general rule, items returned incomplete, damaged or soiled by the customer will not be taken back. In the case of returned goods, shipping costs are at the customer’s expense.  
 
 

Return conditions

In the event of dissatisfaction, goods may be returned and exchanged, subject to presentation of proof of payment. Goods must be returned in their original packaging, unused, clean, complete and undamaged. Items damaged or soiled by the customer cannot be returned.  
 
It is the customer’s responsibility to check the goods immediately upon receipt and to report any defects or deviations from the order. 
 
Returns are possible within 30 calendar days of receipt. If the customer is unable to provide confirmation of receipt, the 30-day period is counted from the date of dispatch of the order.   
 
Only items in their original packaging, unused, clean, complete and undamaged, accompanied by the label or proof of purchase, will be taken back. 
 
In the case of a return, the customer is responsible for the shipping costs and bears the shipping risk. Goods can be returned by post to the following address (against signature):

After receiving the goods, RED-DOLPHIN will check that they are in good condition and, if necessary, will decide on a refund. Once our logistics department has received and checked your return, the refund will be credited to the same payment method used to pay for your order.
Only the value of the goods will be refunded. Shipping costs, if any, will not be refunded.   
 
 
Special conditions for the return of multimedia items 
 
Goods must be returned complete, clean and unused in their original packaging, with all accessories included in the same delivery, in the original unopened packaging and, if applicable, with an intact seal. 
 
 

GUARANTEE 

The customer will notify RED-DOLPHIN support(at)red-dolphin.com of the problem encountered and will be contacted if necessary by email or telephone to resolve the problem (if it is a technical problem). Once RED-DOLPHIN’s agreement has been received, the customer may return the product (at his own expense).  
The invoice serves as a warranty certificate. 
Warranty exchanges or repairs do not extend the original warranty period (usually 2 years). 
 
 

RESOLUTORY CLAUSE

Any total or partial non-fulfilment by the customer of one of his obligations, as well as the non-observance of any due date of payment can involve, with the discretion of RED-DOLPHIN, either the immediate exigibility of the sums still due with whatever title that it is, and the suspension of any delivery, or the resolution of the contracts in progress.
 
 

APPLICABLE LAW / DISPUTES

This contract is subject to Swiss law.
